1. Agreement to Terms
By accessing or using MarketLab ("the Service"), operated at market-lab.ai, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you (whether personally or on behalf of an entity) and MarketLab ("we," "us," or "our").
2. Description of Service
MarketLab is an AI-powered marketing experimentation platform that enables users to:
- Generate ad copy and email variants using artificial intelligence (Anthropic Claude)
- Run structured A/B tests across Meta Ads, Google Ads, and Email campaigns
- Analyze experiment results with real-time performance data
- Automatically identify and advance winning creative variants
- Manage brand profiles, approval workflows, and team collaboration
3. Accounts
3.1 Registration
You must create an account to use the Service. You agree to provide accurate, complete, and current information during registration and to keep your account information up to date.
3.2 Account Security
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately at legal@market-lab.ai if you suspect unauthorized access to your account.
3.3 Organization Accounts
If you create or join an organization account, the organization owner or admin may have additional rights to manage your access, view your activity within the organization, and control organization-level settings.
4. Billing and Subscriptions
4.1 Free Trial
We may offer a free trial period. At the end of the trial, your access may be limited unless you subscribe to a paid plan. We reserve the right to modify or discontinue free trials at any time.
4.2 Paid Plans
Paid subscriptions are billed in advance on a monthly or annual basis through Stripe. All fees are quoted in U.S. dollars unless otherwise stated. Prices are subject to change with 30 days' prior notice.
4.3 Cancellation and Refunds
You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. We do not provide prorated refunds for unused time within a billing period.
4.4 Failed Payments
If a payment fails, we will attempt to charge your payment method again. If payment remains unsuccessful, we may downgrade or suspend your account after providing notice.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws, regulations, or third-party rights
- Generate or distribute misleading, deceptive, or fraudulent advertising content
- Infringe on intellectual property rights of others
- Transmit malware, viruses, or other harmful code
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service for any purpose that violates the advertising policies of Meta, Google, or other connected platforms
- Scrape, crawl, or use automated means to access the Service without our written consent
- Resell or redistribute the Service without authorization
We reserve the right to suspend or terminate your account if we reasonably believe you have violated these terms.
6. AI-Generated Content
6.1 Nature of AI Output
The Service uses Anthropic's Claude AI to generate ad copy, email variants, reports, and other content. AI-generated content is provided as suggestions and starting points. It may contain errors, inaccuracies, or content that does not comply with platform advertising policies.
6.2 User Responsibility
You are solely responsible for reviewing, editing, and approving all AI-generated content before it is published or sent. MarketLab provides approval workflows to facilitate this review, but the final decision to publish rests with you. We are not liable for any consequences arising from your use of AI-generated content.
6.3 No Guarantees
We do not guarantee that AI-generated content will be accurate, suitable for your purposes, compliant with advertising platform policies, or free from bias. You should apply your own judgment and comply with all applicable advertising regulations and platform policies.
7. Intellectual Property
7.1 Our Property
The Service, including its original content (excluding user-generated content), features, and functionality, is owned by MarketLab and is protected by copyright, trademark, and other intellectual property laws. Our name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks.
7.2 Your Content
You retain ownership of all content you create or upload to the Service, including ad copy, brand profiles, and experiment configurations. By using the Service, you grant us a limited license to process, store, and display your content as needed to operate the Service.
7.3 AI-Generated Content Ownership
Content generated by the AI features of the Service based on your inputs is yours to use. We do not claim ownership of AI-generated outputs created through your use of the Service.
8. Third-Party Integrations
The Service integrates with third-party platforms including Meta Ads, Google Ads, and various email services. Your use of these integrations is subject to the respective terms and policies of those platforms. We are not responsible for the availability, accuracy, or policies of third-party services.
You are responsible for ensuring that your use of the Service in connection with third-party platforms complies with their terms of service and advertising policies.
9. Limitation of Liability
To the maximum extent permitted by applicable law, MarketLab and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, revenue, goodwill, or other intangible losses, resulting from:
- Your use of or inability to use the Service
- Any AI-generated content created through the Service
- Unauthorized access to or alteration of your data
- Actions taken by third-party platforms (e.g., ad disapprovals, account suspensions)
- Any interruption, suspension, or termination of the Service
In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim.
10. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
11. Indemnification
You agree to indemnify and hold harmless MarketLab and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitation of liability.
You may terminate your account at any time by contacting us or using the account deletion option in your settings. Upon account deletion, we will handle your data in accordance with our Privacy Policy.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
